The charge stems from allegations that Lohan, 24, took a necklace from a Venice, California jewelry shop last month. Deputy District attorney John Lynch said that she will be arraigned on the charge at 1:30 Wednesday.
The District Attorney's office released a statement stating the actress "allegedly walked out of the store with the necklace on January 22. The owner reported the theft to the Los Angeles Police Department, which investigated the allegation and presented evidence to the D.A.'s office last week."
The necklace in question is valued at $2500 and has been handed over to police before they searched Lohan's Venice, CA appartment with a search warant last week.
Lohan's lawyer Shawn Chapman Holley said Saturday, "We vehemently deny these allegations and, if charges are filed, we will fight them in court, not in the press."
This latest run in with the law comes five weeks after shw was released fom a court ordered rehabilitation and weeks before her next court appearance to free her of supervised probation for a 2007 drunk driving conviction.
